Terms of Service

These Terms govern your use of makewine.app (“MakeWine”), a service operated from Ireland by [legal entity — to be confirmed before launch]. By creating an account or using the service you agree to these Terms and to our Privacy Policy.

1. The service

MakeWine is winemaking software for tracking fermentations, managing vineyard and cellar records, running wine-chemistry calculators, generating export certificates and provenance QR codes, and sharing recipes, via the web app and Android app.

2. Accounts

• You must be of legal drinking age in your jurisdiction and provide accurate information.
• You are responsible for your account and for keeping your password secure.
• We may require email verification and may suspend accounts that breach these Terms.

3. Subscriptions, billing & cancellation

• We offer a free tier (Cellar Hand) and paid plans (Winemaker, Vineyard, Estate, Winery). Current prices are on the pricing page.
• Paid plans are billed in advance and renew automatically until cancelled.
• You can cancel any time via the Stripe billing portal in Subscription settings; access continues until the end of the paid period.
• Refunds: by subscribing you expressly request that the service begins immediately and you acknowledge that you therefore lose the 14-day right of withdrawal that would otherwise apply to digital services. You can cancel at any time via the billing portal to stop future renewals; we do not provide partial refunds for the current billing period, except where required by law.
• We may change prices with reasonable advance notice; changes do not affect the current paid period.

4. Acceptable use

Don’t misuse the service: no unlawful content, no attempts to breach security or rate limits, no scraping or overloading the API or webhooks, and no infringing others’ rights.

5. Your content & intellectual property

• You retain ownership of the data and content you create. You grant us the licence needed to host and operate the service (e.g. to display content you choose to make public).
• Public profiles, recipes, and provenance pages you choose to publish are visible to others.
• The MakeWine software, brand and site content are our intellectual property.

6. Calculators & guidance — important disclaimer

The calculators, suggestions, fermentation health indicators, and educational content are provided for guidance only and are deterministic estimates, not laboratory certifications or professional advice. Always verify critical additions (e.g. SO₂, acid) against your own measurements and follow applicable food-safety and labelling regulations. You are responsible for your finished product.

7. Disclaimers & limitation of liability

The service is provided “as is” without warranties to the maximum extent permitted by law. To the extent permitted by law, our aggregate liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.

8. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate access for breach of these Terms.

9. Governing law

These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
