These Terms govern your use of makewine.app (“MakeWine”), a service operated from Ireland by Mel McCann, a sole trader trading under his own name, of C/O Wicklow Hub, Block B, Newtown Business Park, Newtown Mount Kennedy, Co. Wicklow, A63 XV26, Ireland. By creating an account or using the service you agree to these Terms and to our Privacy Policy.
1. The service
MakeWine is winemaking software for tracking fermentations, managing vineyard and cellar records, running wine-chemistry calculators, generating export certificates and provenance QR codes, and sharing recipes, via the web app and Android app.
2. Accounts
- You must be of legal drinking age in your jurisdiction and provide accurate information.
- You are responsible for your account and for keeping your password secure.
- We may require email verification and may suspend accounts that breach these Terms.
3. Subscriptions, billing & cancellation
- We offer a free tier (Cellar Hand) and paid plans (Winemaker, Vineyard, Estate, Winery). Current prices are on the pricing page.
- Paid plans are billed in advance and renew automatically until cancelled.
- You can cancel any time via the Stripe billing portal in Subscription settings; access continues until the end of the paid period.
- Refunds: by subscribing you expressly request that the service begins immediately and you acknowledge that you therefore lose the 14-day right of withdrawal that would otherwise apply to digital services. You can cancel at any time via the billing portal to stop future renewals; we do not provide partial refunds for the current billing period, except where required by law.
- We may change prices with reasonable advance notice; changes do not affect the current paid period.
4. Acceptable use
Don’t misuse the service: no unlawful content, no attempts to breach security or rate limits, no scraping or overloading the API or webhooks, and no infringing others’ rights.
5. Your content & intellectual property
- You retain ownership of the data and content you create. You grant us the licence needed to host and operate the service (e.g. to display content you choose to make public).
- Public profiles, recipes, and provenance pages you choose to publish are visible to others.
- The MakeWine software, brand, and site content are our intellectual property.
6. Where your data is held, and what we do not do with it
- Our servers are in the United Kingdom and our backups are held in the European Union. Your records are not stored outside the UK/EEA. How we handle personal data — the lawful bases, your rights, and who processes data on our behalf — is set out in the Privacy Policy, which forms part of these Terms.
- We do not use your data to train models. The fermentation, vineyard, and calendar suggestions are produced by published agronomic and winemaking models running as arithmetic over your own records — there is no machine learning and no language model in them.
- Your data is never used to generate suggestions for another customer. There is no pooling or aggregation across accounts.
- Where you record a real observation — for example the date budburst actually happened — we use it to correct that block’s own forecasts for the remainder of that season. That is a calculation applied to your own data, in your own account; nothing is retained as a learned parameter, and deleting the observation removes the effect.
- The optional AI assistant add-on is the one feature that sends text to a third-party model provider, and only when you choose to use it. It is off unless you subscribe to it, and it is described separately at the point of purchase.
7. Availability and support
We aim to keep the service available and to answer support requests promptly, but we do not offer a service-level agreement or a guaranteed response time, on any plan. MakeWine is run by a small team; we would rather say that plainly than promise an SLA we cannot honour. Planned maintenance is announced where practical, and we may change or discontinue features with reasonable notice.
8. Devices and third-party integrations
MakeWine can receive readings from third-party hardware (for example Tilt and RAPT devices) and uses third parties for payments and email. Those products are not ours: we do not control their accuracy, availability or firmware, and a gap or error in the data they send is not something we can correct after the fact. Readings are a record of what a device reported, not a measurement we certify.
9. Calculators & guidance — important disclaimer
The calculators, suggestions, fermentation health indicators, and educational content are provided for guidance only and are deterministic estimates, not laboratory certifications or professional advice. Always verify critical additions (e.g. SO₂, acid) against your own measurements and follow applicable food-safety and labelling regulations. You are responsible for your finished product.
10. Disclaimers & limitation of liability
The service is provided “as is” without warranties to the maximum extent permitted by law. To the extent permitted by law, our aggregate liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.
11. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate access for breach of these Terms.
12. Governing law
These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
